Dribbler Release of Liability, Assumption of Risk & Indemnification Agreement

Purpose of This Liability Waiver

This Release of Liability, Assumption of Risk, and Indemnification Agreement ("Agreement") is a legally binding waiver required for all Clients, parents, guardians, and adult participants who take part in any soccer training sessions arranged through the Dribbler platform.

By signing this Agreement, you acknowledge and agree that:

• Dribbler LLC operates solely as a scheduling and matching marketplace, and does not provide, supervise, or control soccer training services.

• All soccer training sessions are provided by independent Contractor Trainers ("Trainers"), not employees of Dribbler.

• Participation in soccer and related physical activities involves inherent risks, and you voluntarily choose to participate or allow your child to participate.

• This Agreement is required before any training sessions begin, and applies to all current and future sessions booked through Dribbler.

Binding Effect

By signing electronically, you acknowledge that this Agreement is:

• Legally binding

• Enforceable against you

• Signed on behalf of any minor you register

• Equivalent to a handwritten signature

• Governed by the same Arbitration Agreement & Class Action Waiver contained in the Dribbler Terms of Service

Assumption of Risk

I understand and acknowledge that participation in soccer training, physical activity, conditioning drills, and related exercises arranged through the Dribbler platform involves inherent and unavoidable risks. These risks exist regardless of the care, preparation, or skill of the Trainer, the participant, or any other person.

These risks include, but are not limited to: slips, trips, and falls; sprains, strains, fractures, and dislocations; collisions with other participants, objects, or equipment; muscle soreness, bruising, or overexertion; concussions or head injuries; impacts from soccer balls or equipment; weather-related risks (heat, cold, lightning, sun exposure); dehydration or heat exhaustion; uneven or unsafe field conditions; allergic reactions or environmental irritants; emotional frustration or stress; accidents caused by other individuals outside the Trainer's control.

I understand that these risks cannot be eliminated without jeopardizing the essential qualities of the activity. Trainers may adjust or modify drills for safety, but risk is still present. Sessions may take place in public parks, open fields, community spaces, or private properties where additional risks may exist. Dribbler LLC does not supervise, control, or monitor training sessions.

By signing, I voluntarily assume full and complete responsibility for all risks of injury, illness, damage, or harm that may occur to myself or my child during or after participation in any Dribbler-related activity. I further agree that participation is entirely voluntary, and I may choose to discontinue participation at any time.

Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless: Dribbler LLC; its owners, members, managers, officers, directors, employees, agents, and representatives; all independent Contractor Trainers matched through the Dribbler platform; any volunteers or individuals assisting with training; owners and operators of parks, fields, gyms, homes, or other locations where training occurs; landlords, property managers, and facility staff; any affiliated or associated persons or entities (collectively, the "Released Parties").

This release covers any and all claims, demands, causes of action, liabilities, damages, losses, expenses, or obligations, whether known or unknown, arising out of or connected with: participation in soccer lessons or related activities; the actions, inactions, or negligence of any Trainer or participant; conditions of the training location; weather, environment, or equipment issues; injuries, accidents, or incidents occurring during or after a session; communication or coordination directly between Client and Trainer; use of personal or public facilities and equipment; any activities occurring before, during, or after the scheduled session; any transportation arranged independently by the Client or Trainer.

This release applies to: bodily injury; illness; permanent disability; death; property damage or loss; emotional distress; financial loss; any other harm or consequence connected to participation.

I understand and agree that Dribbler LLC: does not provide or supervise soccer training services; does not control Trainer conduct; is not responsible for verifying the safety of training locations; cannot guarantee safety, results, or injury prevention.

By signing this Agreement, I waive the right to bring any lawsuit, claim, or legal action against any Released Party for any injury or harm suffered in connection with Dribbler-related activities. This release is intended to be as broad and inclusive as permitted by the laws of the State of New Jersey.

Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, actions, suits, damages, losses, liabilities, costs, or expenses (including attorney's fees and court costs) arising out of or related to: my or my child's participation in any soccer training session; injuries, accidents, or incidents occurring before, during, or after a session; my own or my child's acts, omissions, negligence, or misconduct; damage to property belonging to Trainers, other participants, or the training location; failure to follow instructions, rules, safety guidance, or Trainer direction; any misrepresentation or failure to disclose medical conditions; any communication or coordination between me and the Trainer; any violation of the Dribbler Terms of Service or this Agreement; any claim brought by a third party arising from my or my child's participation; any off-platform meetings, payments, or arrangements; my decision to train at a particular field, home, park, or facility; the presence or actions of any individuals I bring to the session (siblings, friends, family, pets, etc.).

This obligation applies even if the claim, injury, or incident is alleged to have been caused in part by: the negligence of a Trainer; hazards or conditions of the property; acts or omissions of other participants; weather or environmental factors.

I understand that I am responsible for all costs, damages, and legal fees arising from any claim connected to me or my child. The Released Parties may tender or assign defense of any claim to me. My indemnification obligations survive the completion of lessons and termination of my account.

Medical Authorization

I certify that I am the parent or legal guardian of the minor participant, or I am an adult participant age 18 or older, and I hereby give my full consent for participation in soccer training activities arranged through the Dribbler platform.

1. Responsibility to Disclose Medical Conditions. I am solely responsible for informing my assigned Trainer of any medical conditions, allergies, physical limitations, injuries, disabilities, or special needs affecting myself or my child. I acknowledge that Dribbler LLC does not evaluate, verify, review, or monitor any medical information; Trainers are not medical professionals and cannot assess medical fitness or emergency risks; failure to disclose relevant medical conditions increases the risk of injury and is my responsibility alone.

2. Permission to Administer Basic First Aid. In the event of an injury during a training session, I authorize the Trainer to provide basic first aid only, such as: applying ice; cleaning minor cuts or abrasions; minor non-invasive assistance. I acknowledge that Trainers are not EMTs, nurses, or medical providers, may not carry medical supplies, and cannot diagnose injuries or provide medical treatment.

3. Authorization for Emergency Medical Care. If a medical emergency occurs, I authorize the Trainer, Dribbler LLC, emergency personnel, or any supervising adult to: call 911; request emergency medical assistance; allow transportation to an emergency facility; provide information to emergency responders as needed. All costs of emergency care, ambulance transport, treatment, or follow-up care are my sole responsibility. Dribbler LLC and the Trainer assume no liability for decisions made in good faith during an emergency.

4. No Medical Advice Guarantee. Trainers do not provide medical evaluations, injury assessments, or health advice. Any suggestions regarding stretching, hydration, warm-ups, or similar topics are general guidance only and not medical recommendations. Participation in training while injured or ill is entirely my decision and responsibility.

5. Fitness to Participate. I certify that the participant is physically able to engage in soccer training activities, that there are no undisclosed medical conditions that would make participation unsafe, and that I am solely responsible for obtaining medical clearance if needed.

Participant Guidelines & Rules

1. Parent/Guardian Supervision (For Minors). A parent or legal guardian must remain present and available for the entire duration of every session involving a minor participant. I am solely responsible for supervising siblings, friends, pets, and any other individuals I bring to the session. Trainers are not babysitters, childcare providers, or responsible for the supervision of minors outside the instructional activity.

2. Safe Training Environment. I am responsible for ensuring that the training location is safe, clear, and free of hazards; appropriate in size and surface for physical activity; indoors or outdoors in a reasonably safe condition; free from dangerous objects, debris, holes, or obstacles. Dribbler does not inspect or approve training locations and is not responsible for unsafe areas.

3. Proper Attire & Equipment. The participant will arrive with athletic shoes or cleats, weather-appropriate clothing, adequate water for hydration, and any personal equipment needed for participation.

4. Compliance With Trainer Instructions. The participant must follow Trainer directions at all times, use equipment as instructed, participate safely and respectfully, avoid behaviors that endanger themselves or others, and respect boundaries and maintain appropriate conduct. Trainers have full discretion to stop, modify, or end the session if unsafe behavior occurs.

5. No Interference During Sessions. I agree not to interrupt drills excessively, coach over the Trainer, pressure the participant to exceed their safe limits, or demand drills that the Trainer believes are unsafe. The Trainer's judgment regarding safety, pace, and drill selection is final.

6. Weather & Environmental Conditions. Outdoor sessions may involve heat, cold, sun exposure, wind, or rain; uneven ground, natural obstacles, or public interference. The Trainer may cancel, delay, or adjust the session if conditions are unsafe.

7. Illness & Fitness to Participate. The participant is physically able to engage in soccer training, is not ill, contagious, or injured, and will not attend if experiencing fever or symptoms of illness.

8. Respectful Behavior. All participants and parents/guardians must behave respectfully toward the Trainer, other individuals in public spaces, and other participants. Harassment, aggression, or inappropriate behavior may result in immediate termination of the session.

9. Off-Platform Conduct. I agree not to arrange private sessions with a Trainer outside the Dribbler platform, pay Trainers directly, exchange inappropriate communications with Trainers, or meet with Trainers socially or in non-training contexts. Such conduct voids protections and may lead to account removal.

Photography & Media Consent

Photos and videos may be taken before, during, or after soccer training sessions arranged through the Dribbler platform. I give permission for the Trainer, Dribbler LLC, or any person authorized by Dribbler to take photographs, video recordings, short-form or long-form media, and session snapshots or instructional recordings of the participant, myself, or incidental individuals present at the session.

I grant Dribbler LLC the unrestricted right to use, reproduce, edit, publish, distribute, or display these images or recordings, in any medium, including marketing materials, social media, website content, training or safety materials, advertisements, internal documentation, and promotional campaigns. This permission is royalty-free, perpetual, worldwide, and irrevocable, unless I submit a written request to opt out.

Trainers, other participants, and bystanders may appear incidentally in photos or videos. I release Dribbler LLC and all Trainers from liability related to such incidental appearances. No compensation will be provided for appearing in any media.

I may opt out of photo/video usage for marketing purposes by sending written notice to support@dribblersoccer.com. Opt-outs apply only to future usage and do not require deletion of prior content already created or published.

Final Agreement

I confirm that I have carefully read, understand, and voluntarily agree to all terms contained in this Liability Waiver and Release, including: Assumption of Risk; Release of Liability; Indemnification; Medical Authorization; Participant Guidelines & Rules; Photography & Media Consent; and all additional terms incorporated by reference.

I understand that this document is a full waiver of legal rights, that I may be prevented from suing Dribbler LLC or any Trainer, that this waiver is valid even if I do not read every word, that this waiver is enforceable under New Jersey law, that this waiver applies to all current and future sessions unless revoked in writing, and that this waiver is binding on myself, the participant, my spouse, family members, heirs, executors, and assigns.

I agree that my electronic signature has the same legal effect as a handwritten signature, that the date and signature captured electronically constitute a valid execution of this Agreement, and that this document may be signed and stored electronically by Dribbler LLC.

If signing on behalf of a minor participant, I affirm that I am the lawful parent or legal guardian, accept full responsibility for the minor's participation, and agree to all terms of this Agreement on behalf of the minor.

This Agreement is governed by the laws of the State of New Jersey. If any provision is found unenforceable, the remaining provisions will continue in full force.
